GENERAL TERMS OF USE OF THE SITE

These general Terms of Use apply to any person or entity (user, you), regardless of geographical location, who uses and accesses the Site. Accessing or using documents, files or photos found on the Site constitutes consent to the following provisions and is subject to your acceptance of and compliance with these provisions. Please read this section carefully, and if you do not accept these terms, you should not access the Site or download any content.  On the Site, you can access these Terms of Use easily, freely and at any time by clicking the “Terms of Use” link.

We may update these Terms of Use at any time without notice to you. Your continued use of the Site following the posting of revised Terms of Use means that you accept and agree to the changes. TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL BEL CHEESE CANADA INC., ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE. You agree to defend, indemnify, and hold harmless Bel Cheese Canada Inc., its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the Site, any use of the Site’s content, services, and products, either by you or by users of your account, other than as expressly authorized in these Terms of Use or your use of any information obtained from the Site.

APPLICABLE LAW

These terms and conditions are governed by and construed in accordance with the laws in force in the province of Quebec and the federal laws of Canada applicable therein. Any dispute arising hereunder shall be subject to the jurisdiction of the courts of the District of Montreal, Province of Quebec. If any provision of these Terms of Use is deemed invalid by a competent court, this will not render invalid all other provisions, as the invalid provision will be separated from the remaining provisions of these Terms of Use, which will remain in effect.

PASSWORD AND ACCESS CODE

If applicable, you agree to keep your password and access code secret and confidential. Any use of identifying information is entirely at your own risk. In case of loss or theft or fraudulent use of one of these identifying elements, you are required to notify Bel Cheese Canada Inc. as soon as possible. This notification must be confirmed by registered letter.
